Terms of Service

1. Account Creation

When using certain services, you may need to create an account. You commit to providing accurate, complete, and up-to-date information. You are responsible for maintaining the security of your account, including protecting your password and limiting access to your computer.

2. Account Responsibility

You are responsible for all activities that occur under your account, whether or not these activities are authorized by you. If you suspect unauthorized use of your account, you must notify us immediately.

3. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account or make a purchase. The service is not directed to children.

1. Lawful Use

You agree not to use our services for any illegal or unauthorized activities, including but not limited to:

• Violating any applicable laws, regulations, or rules
• Infringing on the intellectual property rights, privacy rights, publicity rights, or other rights of third parties
• Uploading images of, or generating media depicting, a real person without their consent — including non-consensual likenesses, impersonation, or deceptive "deepfakes"
• Creating sexually explicit material, any content involving minors, or hateful, harassing, or violent-extremist content, or anything that violates the acceptable-use policies of the AI providers that power the service (including Google)
• Generating content intended to deceive, defraud, or spread disinformation, or presenting AI-generated media as real where doing so is unlawful or misleading
• Distributing malware, viruses, or other harmful code
• Attempting unauthorized access to our systems or other users' accounts, or reselling, proxying, or otherwise repackaging the service as a generic model API

2. Service Modifications and Termination

We reserve the right to modify or terminate parts or all of the services at any time, with or without prior notice. We are not liable to you or any third party for any modification, suspension, or termination of the services.

3. Usage Limitations

Some service features may be subject to usage limitations, especially for free services or during trial periods. Exceeding these limitations may require upgrading to a paid plan or waiting until the next reset period.

1. How generation works

The service generates images and video using third-party AI models (including Google's Veo and Gemini / "Nano Banana" image models). When you generate, your prompts and any images you upload are transmitted to and processed by these providers to produce your result, subject to their terms and acceptable-use policies.

2. Your uploads

You represent and warrant that you own or have all rights, licenses, and consents necessary for the images and other material you upload, and that your uploads and the content you generate from them do not infringe any third party's rights or violate any law. You are solely responsible for the material you upload and the content you generate.

3. Ownership of output and licensing

As between you and us, you own the images and videos you generate, and we do not claim copyright over your output. Commercial-use rights depend on your plan: the Starter pack is for personal, non-commercial use only, while the Pro and Studio plans include a commercial-use license. Because generative models can produce similar results for different users, we do not warrant that any output is unique, and AI-generated material may not be eligible for copyright protection in some jurisdictions.

4. Responsible use of output

You are responsible for how you use, publish, and distribute generated content, including any disclosure that it is AI-generated where required by law or platform policy. We may suspend or terminate accounts that use the service in breach of these Terms.

1. Pricing and Subscriptions

We offer various service plans, each with different features and pricing. Subscription prices and terms are clearly listed on our website. We reserve the right to change prices at any time, but will provide advance notice to existing subscribers.

2. Payment Processing

Payments are processed through our third-party payment processors (such as Stripe). You agree to provide accurate payment information and authorize us to charge your payment method.

3. Credits

Paid features are metered in credits. Credits have no cash value, are non-transferable, and are consumed when a generation runs. One-time (Starter) credits do not expire; subscription (Pro and Studio) credits are a monthly allowance that expires at the end of each billing cycle and does not roll over.

4. Auto-Renewal and Cancellation

Subscriptions renew automatically at the end of each billing period until cancelled. You may cancel at any time from your account; cancellation takes effect at the end of the current period, and you keep access until then. We send a renewal reminder before each subscription renews.

5. Refunds

Refunds are governed by our Refund Policy, which forms part of these Terms. In summary: failed renders that we were not billed for are credited back automatically; a first Starter purchase may be refunded within 7 days if no generation has been run; and we do not refund for creative dissatisfaction or prorate unused subscription time. This does not affect any non-waivable statutory consumer rights.

1. Our Content

All content on Omni Enhance, including but not limited to code, designs, text, graphics, interfaces, logos, images, and software, is owned by us or our content providers and is protected by copyright, trademark, and other intellectual property laws.

2. Your Content

For content you upload, submit, store, or post on our services, you retain all rights. You grant us a worldwide, royalty-free, non-exclusive license to host, store, reproduce, modify, create derivative works from, and process such content — including by transmitting it to the third-party AI providers described above — solely to operate and provide the service to you.

3. Feedback

For any feedback, comments, or suggestions you provide about our services, you grant us the right to use such feedback without restriction and without compensation to you.

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that our services will be error-free, secure, or uninterrupted.

2. Third-Party Links and Services

Our services may contain links to third-party websites or services, or integrate third-party functionality. We are not responsible for any third-party content, websites, products, or services.

1. Entire Agreement

These Terms constitute the entire agreement between you andOmni Enhance regarding the use of our services and supersede all prior or contemporaneous communications, proposals, and understandings, whether oral or written.

2. Modification of Terms

We may modify these Terms from time to time. Modified Terms will be effective when posted on the website. Your continued use of our services indicates your acceptance of the modified Terms.

4. Governing Law

These Terms are governed by the laws of the Province of British Columbia, Canada, and the federal laws of Canada applicable there, without regard to conflict-of-law rules. You submit to the exclusive jurisdiction of the courts located in British Columbia — except where mandatory consumer-protection law in your country of residence grants you rights that cannot be waived.
